Acceptance of Terms
By downloading, installing, or using any application published by Drinalytics ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our applications.
License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use our applications for your personal, non-commercial purposes on devices that you own or control.
Restrictions
You agree not to:
- Copy, modify, or distribute the application or any content within it
- Reverse engineer, decompile, or disassemble the application
- Remove any copyright or proprietary notices from the application
- Transfer the application to another person or "mirror" the application on any other server
- Use the application for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to any portion of the application or any related systems
User Responsibilities
You are responsible for:
- Maintaining the confidentiality of any account credentials
- All activities that occur under your account
- Ensuring that your use of the application complies with all applicable laws and regulations
- Any content you create, submit, or share through our applications
Credits, Purchases, and Subscriptions
Some applications, including Of Many Colors, use virtual credits to access features. Credits are purchased as one-time packs or granted monthly through auto-renewing subscriptions billed by Apple to your Apple Account; subscriptions renew unless cancelled at least 24 hours before the end of the current period and can be managed in your device Settings. Credits have no cash value, are not transferable, and are consumed when you generate content. When a generation fails, the credits for that attempt are automatically returned to your balance. Refunds of purchases are handled by Apple under Apple's Media Services terms; if Apple refunds a purchase, the associated credits are removed from your balance, which may result in a negative balance.
Generated Content
Images you generate are created by an automated system from the options you select. You may use the images you generate for personal, non-commercial purposes, including printing and sharing with your family. We make no guarantee that any generated image is unique, and we are not responsible for how generated content is used outside the application. You must not attempt to use the generation features to create unlawful or harmful content.
Intellectual Property
The application and all content, features, and functionality (including but not limited to design, text, graphics, logos, icons, and software) are owned by Drinalytics and are protected by copyright, trademark, and other intellectual property laws.
These Terms do not grant you any rights to use our trademarks, logos, or other brand features without our prior written consent.
Third-Party Services
Our applications may contain links to or integrate with third-party services, websites, or content. We do not control and are not responsible for any third-party services. Your use of third-party services is at your own risk and subject to the terms and privacy policies of those services.
Disclaimers
THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the application will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRINALYTICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APPLICATION.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APPLICATION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.
Indemnification
You agree to indemnify, defend, and hold harmless Drinalytics and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the application or violation of these Terms.
Termination
We may terminate or suspend your access to the application immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the application will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of any material changes by updating the "Last updated" date. Your continued use of the application after any changes constitutes acceptance of the new Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Drinalytics is established, without regard to its conflict of law provisions.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms constitute the entire agreement between you and Drinalytics regarding the use of the application and supersede all prior agreements and understandings.
